At Bennett Richmond we aim to resolve any problems arising out of the breakdown of your marriage or relationship in both a professional and sensitive manner
We attempt to make the procedure of divorce as straight forward and as swift as possible and to minimise acrimony in what are obviously difficult circumstances.
If you and your partner have children, we can help you reach an agreement over the arrangements for them which are in the children’s best interests and having regard to their welfare.
We also suggest the use of Mediation wherever this is possible, and encourage couples to resolve disputes by negotiation both in relation to financial and children matters. However, we recognise that some cases to demand an urgent application to the Court and in these circumstances we will not hesitate to go to Court to protect the interests of our clients.
We can help you with advice relating to finances – maintenance, property transfers, pension implications of divorce, sales and debts. With our advice and negotiating skills out aim is to help you agree a financial settlement which is both realistic and fair and which will provide for you in the future.
If you are setting up a home with your partner then in order to avoid many problems which could arise in the future should you separate, we can draw up a cohabitation agreement which records your intentions about how any assets should be divided in the unfortunate scenario of the relationship ending.
In addition, we can also draw up Prenuptial Agreements.
Should you have suffered from domestic violence (which could be either physical, sexual or psychological) we will discuss with you how best you may be protected. We always respond quickly in cases of an urgent nature, and if necessary an immediate application to the Court can be made for a Non-Molestation and Occupation Order.
If Social Services have been involved we can help guide you through the Child Protection procedure including cases where Court proceedings have been commenced, having regard to the fact that the children’s welfare is paramount.
